What is Laverne's Law?
On January 31, 2018, Governor Cuomo signed Laverne's Law. This law amends the statute of limitations for medical, dental, or podiatric malpractice cases involving negligent failure to diagnose cancer or a malignant tumor. Prior to Laverne's Law, a patient HAD 2 1/2 YEARS from the date of the missed diagnosis to pursue a claim for malpractice. Now, the statue of limitations is 2 1/2 years from the date that the patient discovered or should have discovered the missed diagnosis, UP TO SEVEN YEARS from the date of the last treatment. IT IS IMPORTANT TO NOTE THAT LAVERNE'S LAW ONLY APPLIES TO MALPRACTICE CASES INVOLVING CANCER.
